Lithgow City Council Amendment to Fees and Charges

Lithgow City Council at its Ordinary Meeting of Council held on 23 October 2023 resolved, Min No 23-192, to amend the fee structure relating to Planning Proposals and Amendments to Development Control Plans.

In accordance with Section 610F of the Local Government Act 1993 Council is required to publicly notify the proposed amendments for a period of 28 days and take into consideration any submissions prior to adopting the new fees.

The new fee structure is set out in the following table:

  1. Basic, Standard and Complex Planning Proposal Categories are determined based on the NSW Department of Planning and Environment’s Local Environmental Plan Making Guidelines.
  2. Minor amendments to the Lithgow Development Control Plan refers to changes to controls in a singular chapter.
  3. Major amendments to the Lithgow Development Control Plan refers to changes for multiple chapters, insertion of new chapters, and/or stand-alone development control plans.
  4. No partial refund available.


Current fees are paid in two instalments:

  1. $8,000
  2. Remaining amount
Current fee allows for partial refund of 50 % of instalment 1 if Council does not support the Planning Proposal proceeding to Gateway.

Submissions on the above proposed amendments to Council’s Fees and Charges are invited and should be addressed to the General Manager and be received by the close of business, 4.30pm on 8 December 2023.
